If the pregnant mother was drinking alcohol and taking drugs, can she be charged for anything?

I have a friend who just found out he is going to be a daddy but his girlfriend continues to drink and do drugs. He and her family has tried talking to her about getting help to protect her baby from any harm. No luck there. He is now worried and is unsure of what to do.

Nope, the baby isn't born yet and thus has no rights.

Also, because she may choose to abort the baby at any time, there can "potentially be" no problem since if one arises, she can just abort the pregnacy and avoid having a baby with issues.

You can sue, however, for independence of the male. More than likely this couple wont' stay together, and if the guy doesn't start taking action now - collecting information through recorded conversations, emails, video tapes, etc - and if he doesn't get a laywer NOW - he may end up having to pay 400$ for child care a month to some hooker doing blow while his kid washes her panties because he's mentally retarded and can't get anything done.

At least I'd ask your friend to not claim parenthood.

anyone can call children's services on the pregnant mom to report drinking/drug use. They will drug test her and order her into treatment if she won't comply they have a RIGHT to take the kid after birth. If the child is born and drugs show up in the kids system the state can take the baby right then at the hospital. A LOT OF STATES drug test all newborns. SHE is allowed by law to get a abortion she is not allowed to give birth to a addicted baby without being charged with endangerment. Someone needs to make a report to her doctor and children's services. IF SHE IS NOT FAR ALONG it may be best that she aborts. The only thing he can do is call children's protective services have her FORCED into a treatment if she plans on keeping the baby or help her with $ for a abortion. IF she dose abort children's services can do nothing if she miscarries from her actions it is NOT against the law. Seems to me she dose not want the pregnancy and ALREADY the child could be retarded from her actions i would HIGHLY suggest she get a abortion.

In some jurisdictions if a woman chooses not to have an abortion and then participates overtly in personal behaviour harmful for her foetus she can indeed be prosecuted.

Just last week a woman in Hamilton, Ontario, Canada, a country where the law does not limit abortion at all (a woman may choose a legal abortion up until the time her contractions start) was sentenced to a jail term for such behaviour, which became evident by the condition of her child when it was born.

It more depends on the state you live in but yes for most states there are some form of laws. Like if a woman does not get pre-natal care and something happens with the unborn child than they can be charged with neglect. You can probably look up more information on the web.

The baby could be taklen away from her right after birth and she could be charged with indagering a child or neglect
