many inoncet people are beining sentenced to prison for wrongful reasons. mixed DNA, mixed finger prints, the evidence were not handle properly or were not tested according to the government policy, flase witness and flase testimony .

in chicago, a black man was sentenced to 80 years but after 25 years he was freed and the former govennor relased almost 2, 000 immates from death roll.

someone of them were later found not qulity due to lack of evidence and the list goes on.

what should the gov do to fix those problems and prevent innocent people form being sent to prison?
should the goverment be held responsible if an innocent man was sent to death chair ?

The problem is two-fold in my view. Not only do our court systems suffer from internal corruption, but also the case dockets have become highly bloated, and evidence/testamony are mishandled and the cases themselves are rushed, often handed over to inexperienced lawyers who do nto have the time to properly research or defend the case.

The only solution that I can see would be a harsh deterrent system, revoking every right you have as a prisoner, but also increasing the burden of proof for capital crimes. However, holding the goverment responsible for an innocent man's death would not be the route to go, but instead should be put on the judge's shoulders, or that of the jury possibly. Make it so the death penalty really does mean taking the man's life into your hands.

First of all, most of the cases where these people were sentenced to the death chair and then released were due to advances in DNA and other forensic evidence. Twenty years ago, we didn't have the capabilities or scientific knowledge we have now - and had to rely on witness testimony and other aspects of the case. Thankfully we're making progress in leaps and bounds, and it's becoming less and less likely that someone would be wrongly convicted.

I'm not saying the system is perfect - far from it. And I would say, it depends on the specific circumstances whether or not the government should be held accountable for these mistakes.

Yes, I do, but I think the problem is less with the government and more with the individual people. For instance, all those convicted have been subject to a trial...by jury. The jury determines the guilt or innocence and recommends a sentence. Until we can eliminate racism and sexism within ourselves, it will never be eradicated from the justice system. I think for that reason, as much as any other, that we should not have the death penalty. If it could be administered fairly, that might be a different matter, but when people are essentially being sentenced to die because of their race, that is unacceptable.

Yes i agree. In texas death row colored people make up about 60 to 70% of the row population.

It was really upsetting that last year a black female was executed with lethal injection in texas. I dont agree that women should be given death penalthy. Its ok for males but doing it to females sounds really sick.

If they dont have a solid evidence about a criminal then they should give him life without parole at least not death because they could end up killing an innocent person which i believe they have done many times.

Glad i dont live in the US.

I don't think so really. I mean the mixed DNA sure, but back before they had perfected DNA you couldn't blame the lawyers and investagators if they didn't get 100% right. (Granted its' a shame that they didn't..don't get me wrong)

But I will say the system is getting pretty sexist.

Take the teacher who was on parole because she was too pretty for prison after sleeping with her 13 year old student...Several of those blonde teacher "babes" are getting off the hook and It hink it's because theya re female. You have a 40 year old man do it to a 13 year old and kerplooie.

Btw I'm a female so i'm not being sexist myself! ;)

You make it sound like everyone who goes through the courts get a raw deal. The courts do the best they can within the framework of the law. Yes, there are people who have been wrongly convicted. There have also been plenty of guilty people who go scot free becuase of technicalities. Is this fair tho the victim?
Each story has 2 sides. No system of govenment is infallable, but I for one would not be in favor of a major overhaul.

The problem lies with the fact that we have the best politicians money can buy... and DID buy. Add to racism, discrimination, and sexism greed, lust, disregard for human life and suffering, disregard for our natural resources, pollution of our waters and air, and you have a nice recipe for human disaster, not to mention disaster for all living things as we know them.

Our government needs to be stripped back to the original documents written by our forefathers and simple language put in to prevent legal manipulation to protect from corporate abuse and white collar crime.

humm I know a lot of people black and white who have been treated unfairly in the judicial system.. there are no checks and balances.. they are allowed to do what they want.. and we should be able to hold them accountable.. but not for true mistakes.. but for very negligent mistakes.. and their Holy then thou attitudes.. like the one judge who told a young black woman he was dismissing her case after she told him she feared her husband.. and then the husband came and set her on fire... that judge was a jerk to many women.. of all races... he should lose his job and be sent to prison for his lack of duty... .sometimes honest mistakes do happen.. but when it is over and over and with an attitude.. then prosecute them and show them what an unfeeling judge is like... :)
