I am having problems with my landlord and need help. We have a water leak and she is saying that WE are responsible for fixing it. Plus, she is threathening eviction if the water situation is not taken care.
Please advise on what kind of rights that I have.

As a landlord, I can say that you being responsible for the plumbing is unlikely. While you would be responsible for damages (ie. kid stuffs toy helicopter down toilet and plumbing needs to be repaired / replaced), it is the landlords responsiblity to have it fixed. They can bill you later if it is determined to be your fault. They usually have to get that in writing from at least one contractor to prove it and then charge you.

This is especially true if the plumbing problem or leak has made your apartment (even just the kitchen or bathroom) uninhabitable.

Check your lease for specifics. If there are none, look up your state or county housing authority and talk to them. They usually can resolve things right away since they know the local laws.

1st ask for a copy of your signed lease to see who is responsible for damages. If you are, you will have to fix it. However, if the landlord is responsible for it, they will need to repair it and cannot kick you out if you don't repair it. If they refuse to give you the lease or repair it, you can sue the crap out of them. I would look for a better place to live in the mean time.

Look at your lease. Does it say you need to keep up the pipes? If yes, you could only pay to fix it and take him to court to get the $ back if they discover its a long term problem that you didnt cause. If he must maintain it, write him a letter and get confirmation from the post office. He must fix it or you can withold rent.

Are you renting the property or just the lot? If it's the lot, then yes you need to fix it. If you are renting the property, then read your lease. It should stipulate the repairs and how they are to be made. Hope you read the thing before you ever signed it.

You nee to refer to the terms ans conditions of your lease. It's different for every ituation, but mostly it should be the landlords responsibility. That is unless they can prove you caused the pwater problem.

And how was the leak caused?
