We live in Ohio. Since January (IT'S AUGUST NOW!!!!) we have been fighting head lice... it has been Dr. proven that she is clean when she leaves my house and is infested when she gets back from the weekend so I know the bugs aren't at my house! She is tired of the treatments and combing and cleaning and just doesn't want to go through it anymore; school is getting ready to start and she doesn't want to miss school. It isn't that she doesn't want to see her dad or step mom, she's just tired of the bugs. They don't have a problem with the bugs (I guess they're used to them?!)

Can a 10 year old make the choice to stop going or do I have to make her go? Do I need to get a lawyer to adjust the visation order to have it be leagal or can we just let them know that she doesn't want to go?

He does pay his child support ($42/month!!!) but has never provided the court ordered health insurance for her. We have been divorced since she was 1.

Check with a lawyer before you make any decisions; you don't you want to give him any ammunition in a court battle (if it comes to that) Most lawyers will give you a free consultation, or may be able to refer you to a legal aid lawyer. What's the worst he can do? Stop paying the $42 bucks? Is it really worth the hassle? You're probably spending more than than treating the whole lice problem.

If she were old enough to make that decision, she should be old enough to recognize areas that have lice. It could possibly be coming from a friend that she plays with in that area, and not his home, or it could be that he takes her to the beach and lets her run and lay in the sand. Does he have a dog? Thats could be another carrier. I wouldn't stop her from seeing him, but I would tell him about the problem, because this is affecting your health too. I would also have her bedding checked. If it is an old mattress, it could possibly be harboring bed bugs or lice that they are not even aware of. Tell him to get it checked, or you will have to, as it is affecting her health. Tell her she has bad allergic attacks as a result of this. That should get him moving. While you're at it, see an attorney about upping that support. If he is not providing the health insurance as ordered, then he should be paying more. Good Luck.

You are asking a very loaded question about if your 10 year old can stop seeing her Dad. Basically, it depends totally on what is in the decree. And, legally, you must contact your lawyer for the proper answer to your question.
As far as her contacting head lice each time she visits, maybe it is time for Child Protective Services to get involved and make a visit to her Dad's residence to resolve any issue(s).

i think that she is old enough and with good reason to stop seeing her father. if i were you i would tell him why she wants to stop going to try to avoid getting the courts involved and he would obviously lose. maybe he will try to take care of the problem.....my friends daughter got it 7x in the past year and could not get rid of it. she is a very clean woman and has a clean house. she found this stuff called lice arrest online and they have not come back since. check it out if it continues to be a problem.

Are you kidding me???? Her father does not have a problem with your daughter getting head lice???? You should be worried what else might go on over there. You should not make her go. I think it is child abuse. It is not a matter of her not wanting to go. He is not providing a safe environment. Let him take her somewhere for a day of fun, just not his filthy home.

I would ask the courts, just call the local office.

Have you spoken to the father about the bugs?

not untill 12 in most states but if you can get a judge with the findings of the docter his rights might get revoked untill he cleans up his house for that is unsanitary

I wouldn't make her go. Her dad sounds nasty. I don't know about the legality of it (call friend of the court), but the poor kid shouldn't have to go if she doesn't want to. Especially when it is endangering her health!!!!

she may want to say no, but most states wont allow a child under 12 to decide for themselvse. sorry.

of course if she is tired of having the bugs that is a medical concern if u have to go to the courst to figure this out then do wut u gotta do if ur child doesn't waana go the don't make her
