I kind of see your point, now one would be able to stop someone from claiming mars or any other planet for that matter if they couldn't even get there in the first place, however the person making the claim would have to be there in person as well to make such a claim, so it would be very unlikely that anyone would even make such a claim in the first place sorry.

I believe The United Nations addressed this issue about 30 years ago and came up with some guidelines for same.

Why do you think america wants to get a moon base, surely not just for the views. They will want to mine the crap out or it, then with that done, move onto mars which they have set their sights on next....my only hope is that the rest of the world band together and take over...

Think of what happened when Columbus discovered the New World. Everyone claimed wherever the put their countrys flag. Only since the United Nations exists, there probably wont be territory wars.

There's nothing to stop them, but there's also no way for them to enforce it. Long-term space travel and colonization is gonna require a lot of money and resources, and collaborative efforts between corporations and nations is what's gonna accomplish it. It'll work out in the end.
