Typically yes, but you would have to check with state law. Most often, the mere presence of a weapon indicates an "armed" offense. The person being robbed has no reason to think the weapon isn't loaded, or isn't real. If you point a gun at someone and they have a heart attack and die, you have still committed a crime of that heart attack is a result of them pointing the gun. You were still responsible for the outcome even if it wasn't through the intended means.

How does the victim know it isn't loaded? My guess is you are still up for the full beef. Also you are more likely to get blown away by the cops if the see a gun in your hand. They never ask "Is it loaded." At most you'll get told once to "drop it" and then they will blast away.

The intent of brandishing a gun during the course of a robbery is to imply that it is loaded and your willing to use it. If its not loaded the robber is definitely stupid. If I was the victim and was armed with an opportunity to use my weapon it would be justifiable homicide if I shot and killed the fool.

Yes, the intention was for people to think the gun is loaded and would be used if necessary.

It's also assault and also possibly a weapons violation depending on your state's laws. It's also a federal crime if the gun ever traveled through interstate commerce.

Yes, because the people you are robbing have no idea if the gun is loaded or not.

Yes,because you used a weapon to deprive another person of their property or possessions. And even though it wasn't loaded, all your victim sees is the weapon.
