When buying a house, my assumption will be that you have not breached the contract. Here are some examples of how a seller can breach a contract:
1. Appraisal bears out conflicting information from listing (example: listing says condo is 750 Sq. Ft., but appraisal says condo is 350 Sq Ft.).
2. Seller offers home to another buyer, after signing the sales contract with you (given, again, you have not breached any terms from your side as buyer)
3. Seller requests terms that are discriminating against a protected class under the law (minorities and single women are usually protected classes)
4. Home is misrepresented (example: buyer says they have been living in home, yet you discover they have been renting the home and not living in it prior to your purchase).
Sure hope this helps, without a bunch of legal mumbo jumbo to make it sound hard.
5. Structural or Pest Inspection finds structural or pest issues not disclosed by Realtor, seller, or builder. Thing like undisclosed leaks, foundation issues, pests, etc., etc., (if applicable for new construction or re-hab).
Bottom line, if it doesn't pass your "smell test" something is probably fishy.

Breach of contract means you have broken a part of the contract like you did something to dat you said you wouldn't do in the contract...

Breach of contract = breaking the terms of the contract.
Definition
1. Wrongful nonperformance of any contractual duty of immediate performance.
2. Failing to perform acts promised by hindering or preventing such performance or by repudiating the duty to perform.

In simple terms it is when one party of a contract fails to do what he or she has agreed to do in the contract within the time frame if there is one of the contract.
