Does anyone know how long it takes from start to finish for a divorce to be finalised? I live in scotland and as of last week will be going through a divorce, I have a 4 year old son but although we will need to go to court to discuss maintenence and access, there is no problems between us in that respect. I have heard it can take usually up to six months, has anyone had it finalised any sooner?

yeah I'm from Scotland..Its two years definately by law. Because your child is under16 if you are the one wanting to innitiate it it will cost you approx 1,000. once he is 16 it is only £63. So it would be advantageous if your husband wanted it as well. These dates are correct.

Hello, i'm currently going through divorce.
My first visit to the solicitors was in January but I didn't start the divorce proceedings until end March. I have been informed that my Decree nisi will be on the 17th aug (YEAH!!!), I then have to wait 6 weeks before I can apply for the Decree Absolute. I should be divorced by October/November. So thats 8 months.

We had no assets or money to argue over and CSA and contact for out daughter was mutually agreed.

My ex delayed 1 month by not signing the papers! He did eventually though.

Well I have a 2 year old daughter and thankfully, both my soon-to-be-ex and I agreed to visitation, custody, and all of the other details without having to go to court. I just signed the final papers today (with the process beginning about 2 months ago) and my lawyer said that it should be finalized in about 5-6 weeks. However, considering that your divorce requires you to go to court, it could drag it out quite a bit longer but hopefully for your sake it does not. Good luck:)

as u live in scotland it might be different regarding the laws there. also depends on whether ur hubby ( ex) and u get along. my ex partner and i had involvment of solicitors and they drew the case out for three years almost...and had a huge legal bill at the end of it too....so watch out for that...as legal aid is not free as u think it might be...and they wanted to put a charge on the house if i didnt pay up once divorce was finalised...so be careful please...i have known of a guy at work who got his divorce in 16 weeks...but he had the kids.and she walked out on them ...it was so clean and cut that there was nothing to argue about so the courts passed it through....hope this helps u in some way...

I am not a divorced women, but I am a divorced man, hopefully that counts? Here in the USA it really matters if the divorce is contested or not. If you two aren't fighting over anything and the divorce is all but ready to go, you could have your day in court within a few months. Hey good luck to ya! P.S. I really love your country! Alot of states have a law regaurding kids and divorces. Join the club. It is a year where I live. That is after a year of separation then you can file for divorce and then the divorce proceedings can happen. I don't know which one I hate the most my ex or going through this.

I very much doubt it.

Mine was 10 months and that was without sorting out the children / support part. If everything is already agreed then you should be able to get the court to agree to it. It's just getting you solicitors to agree to up their pace, and avoid the usual drawn out exchanges of letters.

In our country some states it is very quick...days....in other states you have to be separated for 6 mos. or 1 year. Also, if is non contested and you agree on everything it goes much faster. The less you agree on the longer it will be especially if the disagreements are about the children.
