We've told him he was stupid, shuoted at him, threatened him blah blah blah. But now we want to support the guy, but don't know enough about the whole are of drink driving (UK) to offer him any advice. We do know that he was offered a blood sample by a doctor as his blood/alcohol level was quite low (50/35). However, we want to be able to tell him what his chances are of a fine,ban, jail. What courts will take into account etc etc.....thanks

Depends on how much over the limit? Behaviour? previous convictions(drink related) 1st offence with this 12 month minimum 18 month max. prob (12 month) fine £150/ £200. pending his past and behaviour?
Stupid thing about this law is, it's not against the law to drink and drive, it's against the law to be over the limit!

it will depend on how long it was before his last drink of alcohol and the time the doctor arrived to take the blood. he will lose one unit per hour through his system. he was given statatory option. The leagl limit for blood is 80 m per ml of breath. I supose he is still waiting for the results and has been bailed. If it is a first offence he will get a year ban and a fine. His insurance will increase. The limits should be abolished and anyone caught with alcohol in thier system when driving should be banned.

Yep it stupid, dangerous etc.
But as his blood/ac levels were (relatively) low (should be zero!) a magistrate MAY be lenient if first offence... (or - more likely - first time caught!!) But they do not have to.
He will probably face a fine of around £500 and a 12-18 month driving ban. His insurance company will also do interesting things to his premiums when he next has to insure his car.
But you MUST help him to enforce any driving ban. If he is caught driving whilst banned he is in very serious trouble.
And if he is ever stopped again after drinking he will also face pretty serious consequences.

Usually any drink driver gets a fine and a ban, the lenght of the ban varies. personally I think all drink drivers should be banned for 5 years and made to retake thier test before getting their licence back. Jail is usually only an option if they are a repeat offender or they have had an accident and injured or killed someone through drink driving.

you are allowed 35 milligrams per100 of your breath, if you are 50 or under you get a chance of a blood test but if that is positive then a 12 month ban and a fine are the normal outcome, plus expensive insurance after the 12 month ban

Well if he was famous he would get a £100 fine but because he's not he will either get a massive fine and a ban or a short spell in jail.
If i was the judge i'd send him to jail because drink driving is serious.If he ran over a child or killed someone he would be in serious bother.

I agree - ban and a fine its its a first time offence.
Try and "support" him next time by making sure he doesn't drive home after he's been out for a few drinks! Share a taxi or arrange for someone to be a designated driver. Its cheaper and less hassle than getting arrested or possibly killing someone.

he should be banned for life in my opinion. my fiancee was killed by a drink driver, and he didn't even realise he had hit anyone, he got 3 years in jail, and was out in 18 months, that's not justice, the punishments need to be harder.
i wouldn't care if the person was my mother, i would phone the police and report them my self. U drink and drive U may be lucky and not kill someone, but it Ur choice to drink, its not the persons choice U hit to get killed

He is a very stupid boy for driving and whatever he gets he deserves.
