As others have tried to explain, your girlfriend will lose her conditional status unless she was married for at least two years and had already gone through the interviews and processes for removal of conditionality. One she has a "permanent" (ten-year) card, she can do as she likes.

If you ask her about this and she looks blank or evasive, then she probably did not get her permanent green card and will be illegal if she divorces her husband.

Don't they all....

Isn't that great... has a b/f with her sponsor (husband) on the side... I'm not surprised.

Sucks to be you though.. Actually, it sucks to be her... or both of you.. Lets put it this way...

In 1986, they made the law clear, you had to stay with your sponsored spouse for at least 2 years... Until 1998 rolled around, it jumped up to 7 years. Or, technically a little over.

The fact is, her plan....

....Won't happen. She can either get rid of both, and loose her legality, and leave --OR-- stay anyway, get cought, arrested, have a felony, and be deported --OR-- screw you and stay with her husband...

IF she is found cheating, you and her will both be found responsible, and be charged with felonies...followed by jail time and an express ride on TripleDigits new, "South of the Border Express-train."

--Rob :)

My best advice to you... is to stay the **** out of it. Because, you will go down for her mistake even if your apart of it...

Even if you are a citizen, you will be charged for a felony.

Don't be a dumb***.

1. how long have you been dating?
2. immigration may rule her marriage a 'sham' and deport her. the possibility of then coming back is almost nil
3. if she has a conditional residence card, she's not been here the full 2 years after marriage required for her permanent card. if she does, then she's free to do as she pleases.
4. in all honesty, contact a lawyer to be sure. if the ins rules that it is a 'sham' marriage, they may also try her for visa fraud. if they win, she can never come back.

How long has she been married? I think - and maybe someone else knows the correct number of years - that you have to be married for somewhere between 6-10 years. If you get divorced, you get deported.
