ok well my mom and out neighbor got ina well not a violence fightbut... ok well first they were yelling at us and my mom to go back to mexico. and to get out our green cards, anyways they yelled ALOT of racist comments and a death threat to my mom and sister. they made alot of noise at about 2 am in the morning. my mom asked them politley to be quiet and all they did was mock her. we called the police and they did nothing. anyways my mom got fed up with the comments and the yelling and banging of walls and we already called the cops about 3 times. then she got fed up went into out backyard and threw water with a little bit of chili in it. they caled the cops and well now my mom got a notice on that she broke penal code:242 battery and has to pay or get criminial charges. so who has the right to sue or press charges apon who? can my mom press charges against her?

also yes my other neigbors were awake and they heardf everything. so yah. and they alreadym oved out. we told the polic eman that we would also like to press charges since they were willing to. the only thing that my mom did was just throw the water on them so were good then right?

also does it count that the charges she presses could be dropped becuase she our neighbor was drunk and underage 17 to be axact well she rented the apartment becuase she got married with an older guy. well both them were drunk.

she has right to sue for them making threats well criminal charges can be filed

She has the right to file charges against the people who were yelling out the death threats and the racial epithats. She was the victim of race crimes of a sort. She needs to file a complaint against the police. But she is going to have to get an attorney and make a big stink publicly before it will do any good.

well first af all i know this is gonna sound really bad but if i were you guys i would move if you can? if not then try what you can through the law .but by the sounds of it the law isnt much help there . keep records of every time you call the cops get names of the officers and ask that a report be filed. if there is no result that way tell your landlord if that doesnt help take them to small claims but be sure to have all your ducks in a row if you can set up a audio or video or both to assist you in your case. you need proof or they can turn around and say the same about you guys and turn it into a cross complaint then every one gets a ticket (i know my lousy neighbors pulled that) i wish you the best but if its too much and you can move for your own safety.

The charges against your mom are more severe.
If they do not show up for court the charges may be dropped.

If you have them charged-they will be there and your mom will be in more trouble than them.
