There is nothing you can do. The contract is what is on the paper, not what was in the salesman's mouth.

Children Children, Children
All wheel drive, is not the same as 4 wheel drive.
4X4 has the dash switches etc. All wheel drive is all wheel all the time...if it needs it. if not it is 2 wheel drive and depending on the MFG could be front or rear.
If the Salesman Jerk who sold it to you made the statement he is a representative of the dealership. Check the window sticker, if it says it is then you can get a new car as they won't want to go through the hassle and publicity. If the salesman goes stupid on you then call your local TV station and have their on your side staff.go talk to them. this usually straightens them out. If not go park it out front of the dealership and say they misrepresented the vehicle.

I had a lady in my shop say she got treated like a stupid woman. she wanted just an oil change. When in reality she asked for the oil change a rotate and for the struts to be checked. We called her telling her how much the total bill would be before we do any work and she OK'd it and came down and raised heck. The TV dudes came by and were really getting under my skin when I said you know what, I am sure it was a misunderstanding of what this lady OK'd so in a token of good will I won't even charge her for the oil change...the story never aired and the lady never came back to get her credit....And to my delight she never came back period.

If it isn't on the contract or original invoice you have a long road ahead of you. You should ask the same salesman if he remembers selling you the "ALL WHEEL DRIVE" if he says OH ya Mr Smith how do you like the ALL WHEEL DRIVE. slap him and say it isn't all wheel drive idiot...You have then snagged him He's on the hook and so is the dealership. It is a little shifty but then he did the same to you.
Best of luck

I can't believe you don't know the difference. Try talking with the dealership, but first make sure your paperwork states it's a 4 wheel drive vehicle. Then, if it isn't then you have legal grounds to make them pony up the goods or refund your money. In FOOL.

Go back to the dealership and tell them it isn't all wheel drive. All wheel drive vehicles do not have switches to change them from all wheel to just two wheel. So it may just be a two wheel vehicle.

Sue them for fraud. Do you have evidence that it was told to you it was 4X4?

I bought a "new" car (Buick Regal Turbo Sport Coupe) that turned out to be "used" in 1979. It was supposed to be "the ol' man's personal demostrator" but in fact was licensed in another state by a GM rep who was a friend with the dealer. I got my evidence together and sued them. We settled for the difference in the value of the car as new versus used. My attorney was gracious and charged me $500.00 saying I'd done all the work all he did was negotiate the facts.

So gather all your facts and have an attorney review. If you specifically bought it because of the 4X4, you may have suffered harm in addition to fraud. In TN you can claim 3X the actual damages. In your case the cost of the car as a 2X4 versus 4X4 possibly could be the settlement.

first of all if you have it in writting take it to the head of the dealership if they refuse to help you, i would then contact the ministry of transportation and file a complaint, then contact the better business bureau and the chamber of commerce to see if they tooo can offer some in sight in to this matter. if its not in writting i would go armed with a hidden tape recorder to the person who told you this and get him/her on tape admitting to the fact they deceived you then take the recorder to the mto.

I would have done the research first. Not all but most will tell you what you want to hear for a sale. It's their lively hood. I would bring it back and talk to them. Tell them who told you and that you were sold a car under false pretenses. Usually the sale is final unless it's under warranty.
Good Luck!
