i just need to know what i have to do out side of court to get my son back. i am allready in a better situation then her, i have a drivers liesence, and a car a stable job and place to live, proof that i was never abusive or neglectful to her or our kids. but i know that vt is a " mother" state, that likes to favor the mother, how can i look better to the courts, she allso needs a shrink but refuses to go. just so you know.

I think if your named as the father on the birth certificate that you should pursue this matter in New Hampshire . It sounds to me like you may pursue a kidnapping charge there or put out a warrant for her arrest. The two states may have an agreement concerning extraditing her back to New Hampshire to face the charges. It may be a felony as she took the child across state lines . My advice would be to pursue charges in New Hampshire and take it from their. You may call your local FBI also and ask them questions involving how they handle such matters I'm sure it's come up before . Good luck to you , I know its heartbreaking for you !

First of all why do you not want to go to court? The question is why you two didn't get married in the first place? And how did you have joint custody if you were never married? Joint custody is something set up in legal papers when people are separated and divorced. The only way to get any legal custody, visitation, etc. is to get an attorney and find out what you can do since the two of you weren't married. You can ask more than one atty., usually the 1st hr. is free consultation. And if you are saying she needs a shrink, then you both will be evaluated...not just her.

take all of that plus letters from friends, ur company and of her friends and relatives u can get. school records, hospital reports. and if u can since neither has custody as of yet go file for full custody of ur child. also set up counciling for the child (so u can show the court u are helpin him deal with the divorce if the child is 5 or older) also show what u can offer the child. if in any way with the evidence u have u can prove she is unfit then that will help u out. good luck more fathers need to step up

Since she could argue in court that her children need a female figure in their life, and you do not have that, it would probably be in your best interest to start trying to find a lady who would be willing to be with you and also would like to have your kids around, then if you are providing a stable environment that might be better than where the kids are, there is a chance a VT would at least award you joint custody, there is little chance you can get complete custody unless her current bf abuses the kids and they are willing to testify to that in court.

If you are absolutely sure it is the kids you are fighting for....fight. If you are just looking for revenge....walk away. That said, if you choose to fight, you fight with every last ounce of strength you have. You make huge sacrifices and you get into debt paying a good attorney. (key word: "good"). You are entitled to visitation and that can never be taken away from you. This may involve you going to her state and finding out how to obtain visitation rights/schedule. It may only be a few hours in a public place, (the library, play park, chuckie cheese) but it is your time with your children. Hell, even the murderers on death row have visitation. Then you do your job as a parent to the best of your ability. If they are in school, you attend all their activities and parent meetings. You introduce yourself to the teacher and set up an initial meeting with him/her and make sure all notices are sent to you as well as mother especially report cards. You make yourself available to the children and since you live in a different state, you get computer visitation and regular phone calls. You may not get custody, but you ALWAYS get visitation especially when she starts looking for child support. Consider moving closer to wherever she winds up so you can be part of your children's lives. (Judges love that because it means you put the kids first.) I don't care what the kids call the other guy. If you are a good father, they will know it and look for you. Abusers never really get well, and when he pulls his garbage on her (or God for bid them) you must be available to SEE what is going on and get an order of protection from this monster on behalf of the children. I don't think you can bow out of this fight because it sounds as if your children are in danger. Some dads don't want to cause more emotional stress on their kids and quietly slip into the background.....that's an option if you choose not to fight for them.

You need physical proof that she is unfit or the kids are being mistreated or in a dangerous household,take pics of bad rashes or bruises on the kids and hire a PI if you got the money to keep an eye on your ex and her new b/f

my ex-**** left for florida the monday before fathers day, and not only have I not seen my daughter, I haven't been able to even speak to her on the phone! I called the police--they said its not a police matter
I contacted friend of the ****--I have to pay $100 to file some freaking paperwork to take her to court and who knows when the court date could take place.
so there are those out here who are feeling the pain along with you good luck with your son. I hope you can get him back and win one for our side.
