Do you have to pay for an item you are sent through the mail and didn't want? Can the company report you to the credit bureau if you don't pay?

I received something and kept it although I don't use it and I'm planning on throwing it out because I don't have the time to take time off from work and stand in line to send this stuff back (forgot to mention the money for postage!

What makes the company think they have the right to force merchandise down your throat, whether one wants it or not! I didn't send it back because of the cost of s&h and the time it takes to send it back. They violate MY RIGHTS and steal my precious time.

You don't have to pay for it -- unless the company has a record of you ordering the item.

As a decent, responsible human being you should send it back, but if the company made a mistake and sent you a product that you didn't order, you can consider it a gift.

Did you have any interactions with this company before the product was sent to you? Is it possible that, while you don't percieve that you ordered this product, that you gave this company your name and address through a conversation or inquiry? If this is true, they may try to claim you ordered the product. Again, if the order is in dispute, they have to provide documentation that you affirmatively ordered this product.

And no, they can't attach this to your credit report. They would have to show that you entered into a contract in which you promised to pay for this item after receiving it (i.e. you owe them a debt and are not paying it). If none of this is true and they do put something on your credit report you have a nice lawsuit on your hands.

Yes -- you can be reported to a credit bureau for not paying for it. Call the company and ask them to send you a shipping slip to send it back. If it is for UPS or FedEx, there are usually drop boxes, or you can call them to pick it up from wherever you are. If the company knows that you don't want the product, in most cases, they would rather pay for you to ship it back, then have to pay the credit bureau to hunt you down and make your life a living hell.

Did you open it? Is it as advertised? Did you order it?

Then you have to pay for it.

There is some pretty consumer friendly laws about mail offers, for example if you sign up for a Coffee club and they send you more coffee than you want - you might not have to pay for that.

If they send you items you didn't order (coffee, cd clubs) then I believe the law says you don't have to pay for them. Shove em back in the box... throw some tape on it and leave it on your doorstep with the words return to sender...

You shouldn't have to pay for it!


Then again you could just sell the stuff on ebay - somebody wants it!

If you have it you have to pay ! If you didn't want it you should have send it back.
What makes you think that just because you don't use it you don't have to pay?

If you did not request for the product to be sent then your have no responsibility to return the item.

they can't do that. i think you have the right to keep it without paying for it if you didn't order it.
