I know Montana is a state that will consider a couple married after they have lived as a married couple for a certain number of years and considered themselves a married couple sharing every thing except a marriage licence for the same number of years. I'd like to find out the proper name for this and if there are other states that recognize the same. Mississippi?? I am to be in a wedding (an unofficial, no marriage license wedding) on the high seas between Florida and Mexico in September and I'm trying to help write the vows!?!

These are the requirements for a common law marriage in the state of Texas where I live.

Texas: A man and woman who want to establish a common-law marriage must sign a form provided by the county clerk. In addition, they must (1) agree to be married, (2) cohabit, and (3) represent to others that they are married.

You're talking about a common law marriage, some states recognize them, others don't. Most states a couple would have to live together for something like 7 years.

South Carolina recognizes common law marriage. But I am not sure if many states even care about common law anymore since they are so tied up in this gay marriage issue.

it is called Common Law Marriage. I know Alabama and Texas recognize common law.

Almost all states have a common law marriage, each state varies in how long you have to live together.

California used to be one of them, not anymore...it called common law.
