I'm assuming you're trying to buy this car for yourself because I can't imagine any co-signer wanting to pay for someone else's car. All I know is what my common sense tells me and that's that she 'bought' this car but you only so-signed and agreed to pay if she doesn't. If both of your names are on the title and you buy this car...you're likely to run into legal troubles.

From a legal point of view, I would say no. The purpose of a co-signer is to be the responsible party for payment if the original signer defaults. Just because you pay off the loan without the other person's permission, or knowledge doesn't mean that you're automatically entitled to own the car. She is still the original purchaser, even if the title says "or" instead of "and". You have no right to ownership without her permission. And if you just take the car without her permission, that's stealing, bud!

If she is not paying on it, you can go to the loan company and tell them you want the car since she is not paying on it. There is really nothing you can do if she is paying faithfully on time each pay period.
