If you are talking about health insurance, it is up to the health insurance company whether or not to accept you, whether or not you applied for it through your workplace.

If you are denied insurance coverage, the Federal gov't (or state) may provide it free or at low cost.

My wife was denied by BCBS for being underweight. She gets Medicaid for free now. Most of her prescriptions and all of her doctor bills are paid 100%.

Insurance companies are free to deny coverage to anyone they want.

It depends on the state you live in. Also, check your union contract. If you feel you were treated unfairly, the ACLU may help point you in the right direction.
