A marriage license is required in all states. Just like a drivers license that legally declares you able to drive a marriage license declares you married in all aspects of the law. Without it your marriage IS NOT legal.

Indiana yes- I just got married in may. Actually I think you have to have them everywhere, but certain states require different waiting periods. We walked out with our the same day we applied for it (8 weeks before) and just held onto it until the wedding day

most of the southern states recognize common law marriage. you would need to look up the laws pertaining to your particular state, but i know in alabama the requirements are that you have lived with eachother for at least 6 weeks, you are in a monogomous relationship, and you regard each other as husband and wife (by using the same last name, wearing wedding bands, checking the married box on legal forms, etc...)
