The only rights ILLEGAL ALIENS have are the rights given to them in their country, not ours. A better question is why is the Unites States the only country that tries to afford rights to those who are here ILLEGALLY? Pack them up and send them home so they can have all the rights their country affords them. Maybe that's the problem they don't have rights in their country so they want to come impose themselves on us and steal our rights. It seems to me that our rights are taken away just to accommodate someone who is already ILLEGAL! What do I know I'm just a dumb country boy trying to make it in the city...
Yet it seems to me they are called ILLEGAL! Don't hang your flag in our country. If you want to claim it and hang it, take it and go home. As far as the second amendment it is for we the people of the United States. Not we the people of some foreign country that don't belong here in the first place. Slipping into the back door of our country does not form a more perfect union, it just means your came here illegally and that does not, nor should it ever entitle those who come here that way to any rights. One more thing before I get off of my band wagon! If they're here illegally then they're probably already armed illegally! Just one more reason they need to go home. If this is your land and my land then they need to take themselves back to their land this is not it!

Yes. Because the majority of the Bill of Rights are not rights granted to citizens.
They are limitations on US government action. And that applies regardless of who the US government is acting against. The vast majority of protections afforded by the Constitution have nothing to do with citizenship. Try actually reading the Constitution some time.
Specifically, the 4th Amendment applies against all government searches and seizures where there is a reasonable expectation of privacy. But the courts have already determined that there is no such expectation of privacy during a border search or arrest.
And the 2nd Amendment only applies to federal regulations of guns. It doesn't have any effect on state regulations. But that's beside the point because your example makes no sense. There is no direct interaction between the 2nd and 4th Amendments.

For one, not all of the smugglers are illegal aliens, some are US citizens.
I'm no Constitutional expert so I don't know if they have the right to bear arms, but if they do they still have to go through the legal process that everyone else has to go through (getting permits, waiting periods, etc). And just because they have the right to bear arms doesn't mean they have the right to act illegally with them. Just like US citizens, those who intend to use their guns legally will exercise their right to bear arms legally. Those who don't intend to use their guns legally will just buy them from the trunk of a car in a back alley.
And anyone who says "No, they are criminals so they have no rights" is retarded because much of the Bill of Rights deals with rights and protections for those who are accused of crimes or who have committed crimes (4th,5th, 6th, 8th Amendments)

The Constitution of the United States is just that. The Constitution of THE UNITED STATES.
Illegal aliens are not members of These United States and therefore are not protected by Constitutional rights. Which is the same reason we can hold the suspected terrorists in Cuba without charging them or giving them lawyers. They don't have Constitutional rights.
Personally, I feel if you are caught causing or attempting to cause harm to the United States then you have forfeited your citizenship and your rights. You should be tried, found guilty, and taken out back and shot with the bill for the bullet going to your next of kin.

All people have rights under our constitution, that's why so many try so hard to get here. Who of your family came here? Were they subject to a quota regulation? My ancestors came here to escape famine and persecution. Every person who came to this continent came to escape dissatisfaction with the place and conditions where they were originally from; that includes the ancestors of the "native" Americans, who never had to worry about quota regs. Do non-citizens have rights? Yes, but most are dependent upon their status. Legal immigrants and visitors have the same rights and responsibilities as citizens. Undocumented aliens are usually subjected to the process of being rounded up and deported, no trials, few hearings, and minimal due process. When a government can get away with that, who will be next to receive the same treatment? Could it be you or yours or maybe mine?

Lawbreakers do have certain rights. The right to remain silent...the right to an attorney....etc.
Anyway, this is an interesting question. They probably don't have constitutional rights, but they do have certain rights as human beings. We have to treat them with respect, even if they are here illegally. But, I do NOT believe they have second amendment rights. Of course I would like to dispense with that amendment altogether, but that's a whole other story....

Illegal aliens have no civil rights, and we have many guns to make sure it stays that way. But with this country being soldout from under us by our politicans and corporations, its going to be hard to maintain our right to bear arms, and our right to kick the *** of people we dont want here. Lower wages, lost jobs to outsourcing, drugs and crime because of NAFTA and CAFTA, and thousands if not soon millions of people laying in wait ready to fight us for the freedom to call this home. Yes. Certain constitutional rights. Because most constitutions of modern states are inspired by Principles of 'HUMAN' Rights. The U.S. Constitution is, the Mexican Constitution is also.
There are BASIC HUMAN RIGHTS that Constitutions grant (the case with Mexico) or aknowledge (U.S.) to human beings regardless of CITIZENSHIP...
Entitlement to these basic human rights is not a matter left to the good will of people (I mention this regarding the comment of the person who posted that "we have to treat them with respect"). If it were, just imagine the hanus crimes illegal immigrants would be subject to.
Maybe you'll get a different perspective if you read a book on 'Constitutional Law'.I have, as part of my Master's.

They only have HUMAN rights, not constitutional rights. So if they get in an accident while touring our country, we give them emergency care and send them home to a hosptial in their own home town. We don't allow citizens to abuse them. However, rights to fight their way across the border, take jobs from poor Americans, fill up our schools, protest, carry weapons, take our public assistance, rent our apartments, attack us, force us to learn Spanish to survive the job market, change the laws to lower our educational standards...hell no.
