She has notified the state patrol and pharmacies, and the patient's insurance company. (The criminal also forged the provider's name on an authorization to use that drug over others) Does she need to apply for a new DEA number? Are there any other steps to take? The weird thing is that the drug is a non-schedule drug (antidepressant) and the provider has never seen the patient in any capacity.

The person that forged the name on the prescription is liable, and will face forgery charges when caught, if it has been reported to athorities let them handle it, plus the provider has just cause for a lawsuit against the person. I would check with the DEA to find out if she needs to apply for a new number or not, this could vary from state to state. Reguardless of whether or not it is a scheduled drug or not, it is still forgery. The provider has contacted the proper authorities and they have been notified, perhaps when caught this person will think twice about doing this again. It is also possible that this person will try to get the prescription filled at a out of town pharmacy.

The forger can be arrested. The doctor can sue this patient. I don't think she would have to apply for a new DEA number but would contact the state board of health to be certain.
