A close friend of the family is facing deportation and I was wondering what they do when they deport someone. Do they get a chance to say good-bye to loved ones or not? This friend is in jail in Nebraska and is to face deportation court in 2 weeks.Just what will happen to him if he is deported?

Here is Deportation Process:

1- First INS/ CSIS issues a letter indicating that whatever visa application was, it has been rejected.
2- Then there is a separate department which issues hearing date in Deportation court. Aliens should find an attorney for this date. On such date they present before a judge who sets trial date. If someone does not have felony convictions against them they probably won't be put in Deportation cell but allowed to go home.
3- On trial date if the decision is against Alien the they have a right to appeal.
4- There are two important things: 1- Alien should have an attorney representation. 2- This process takes several years ( 2 or more) provided if they do not have felony conviction. 3-If someone has been in country for more than 10 years and have paid taxes they can request cancellation of deportation. 4- If after INS initial letter they have spent more than 6 months in country without visa they are ineligible for 5 years to reenter USA and if they are in USA more than 1year without visa they will be ineligible for 10 years to reenter. That's the reason seeking an attorney help immediately is vital.
