his public defender is saying that he most likely get 9-16 months and he has already served 6 and has yet to be arraigned. he has no prior record and the robbery was unarmed. he supposedly got away with 7 grand. i was just wondering how realistic is it for him to get 9-16 months considering this crime? it seems like too much of a lenient sentence for a crime like this. please answer if u have knowledge of the law and please serious answers only!

Because the feds don't want the case, he comes under the jurisdiction of the state. Different states have different sentences for bank robbery...some have a mandatory minimum of five years...I don't know about PA> But, in fact he could realistically catch a year to a yr and a half. If so, he should get credit for time served ) in the county jail) and do the remainder . Remember, you said it was unarmed. (Also remember, if he implied a weapon, it elevates to armed...whether or not he had a weapon. ) His clean prior will work in his favor. Whatever you do, help him in his decision making.
