That's if its a family member and the family has no permission to bury their love one, but sneaks the body in American and buries it anyway!

I don't think so, but the State Dept wouldn't like the smuggling of a corpse...probably a felony

Nope. Once your dead you are no longer a citizen of any country. as for the burial I would guess if you bought the plot there would be no reasonable objection to burial. For an example I would offer a situation where one's children immigrated to the U.S. but the parent stayed in the old country. Upon the death of the parent the children wanted the parent in the family plot in the local cemetery. I don't see anyone objecting to this from a legal standpoint.
