Yes......next of kin.....why not get divorced?

The word seperation means exactly that. To be seperated means not fully torn apart. This person is not your next of kin. He is your legal husband who is entitled to everything you own if something should happen to you. Marriage is basicly like murder. There is no statute of limitation just because you are seperated. This is also true for him. No matter how many mistresses, or boyfriends are involved, until you have the divorce decree in hand, you are still legally married.

You certainly are. My ex-wife died and we had been separated for over 5 years. I was not even informed by her parents and found out about her death through a co-worker who was reading the obituaries. Well I went to her parents after and gave them my condolences. I also asked for a copy of the death certificate and birth certificate as she was still under my insurance at work. I was given $10,000 from this insurance policy. I then applied for (live in Canada so rules may be a bit different from where you live) and received a widowers pension from the federal government as she was on a disability pension at the time of her death. Yes it was sad that she had to depart for this to happen, but the reality is she was a very unhappy lady who was really addicted to prescription drugs. She took her own life by intentionally overdosing. So if you are concerned about this then you may want to file for a divorce as it appears you won't be getting back together after a 7 year separation.

You are still married until you divorce. That is as legal as getting married and must be done before you are no longer "next of kin".

If you ask this because you are in or want another relationship and maybe want to get married........sorry you can not do that until you do the divorce thing.

unfortunatly, even after seven years you are still married in the legal systems eyes. however filing for divorce should be much simpler after 7 years of seperation, no fighting over belongings, just the simplicity of putting it down on paper

No not necessarily. See your lawyer, make a will, appoint an executor. For some people life is not just as straight forward as getting a divorce for many reasons, it does,nt mean you have to remain attached to that person.

yes the 7 year law only applies if someone is missing after 7 years they can be declared dead so that there assets can be released

Yes, if you don't want the legal obligations of marriage you must get divorced. Simply being separated or living apart does not sever your legal obligation to your spouse.

I don't think your next of kin has to be a husband or wife. I think you have a choice whom you want to name,i.e. Parents, sister etc.,
