Car accident with illegal alien, DUI, what do I do?

My sister and friend got into a car accident today, they were hit by two illegal aliens in their construction truck, the guys were driving drunk and tried to take off afterward but luckily a cop was following them and got them. Even the cop told my sis, there is little chance of ever getting money but their car is totalled. Any legal advice? She doesn't have a lot of money for repairs.

Even if your sister has uninsured motorist insurance, there still is little she can do. All that's gonna happen with them is that they'll be deported and probably be back here within a week or so. What she can do is see who owned the construction truck and go after them. I was hit by an illegal alien while I was going for a walk and there was nothing that I could have done. I was stuck with the medical bills as well as two fractures in my left knee cap, two broken ribs and a broken nose. I was extremely pissed at first, but then was thankful for still being here. I wish your sister luck because that's pretty much all she can hope for in this case.

First of all I'm very sorry to hear that, something similar happened to me and there was not very much I can do. first of all if your sister has insurance and there was a police report your sisters insurance should be able to cover the damages. In some cases if your sister does not have a "full cover insurance" she might not be covered for damages done by a non licensed driver. and if she has no insurance she is completely out of luck. the second option is that she can sue the 2 individuals. she can take them to a small claim court and the judge will make them pay for the damages done. but the reality is that people like that often don't even have enough money to support them selves so most likely they will just end up doing jail time.

Here's the correct answer. If they were using a company vehicle, you can sue the construction company, as they were using the company's vehicle in the performance of an illegal act. Plus, you could cause their employer a lot of trouble for hiring illegals. You won't see a dime from the driver himself though. The best outcome you could expect there would be getting him deported.

I'd call a lawyer and seek out your options here...you might get satisfaction from the construction company. Otherwise, turning it into the insurance company would be your other option...perhaps they might go after the employer.

Maybe they were working for a company illegaly and your sister could go after that company especially if the construction truck is owned by that company. Unless they stole the truck. owner will pay under table to keep the matter out of the court/law enforcemnts eyes. Other than that...her insurance should cover her car is she has comprehensive coverage. If not then the car isnt financed, she should just sell the car to a junk yard and use the money for a down payment on another car.

Wow thats an incredible story, I'm glad they caught those bastards at least. There has to be some sort of legal precedent for such a case, I would investigate, get in touch with a lawyer, unfortunately I'm not sure on this topic, I have a friend who just took the bar exam lol i'll see what he thinks.

She should definitley go after the construction company that owns the truck.
Other than that, forget about the ILLEGAL *******.
She wouldn't get anything out of them anyway........
