My boyfriend has 3 kids. They were taken away from him while he was with his ex for child abuse. She was charged and accused of child abuse she broke the 8 month olds leg. She had another child after that incident. Shes in prison right now and I need to know what kind of privelages she has. She wants to take the last child that she had. But im not sure if she has any rights.

She is in prison for child-abuse....4 year sentence..the baby had multiple fractures...14 of them to be exact... has served 2 years of her 4 year sentence...

They were never married....they were together for 4-5 years.....comon law marriage i think

I have been through child custody battles for years. I can have an upstanding status in the community, a good job, dependable transportation, keep up on my child support payments, and the mother will still have custody of the children, even if the courts find her guilty of child abuse, neglect, abandonment. It is not a fair world, so unless you have a darn good attorney, you're screwed.

Was the ex an ex wife or an ex girlfriend? If she was an ex girlfriend he should start by making sure he has legal right. He needs to start by making the kids legally his. In Georgia if a child is born out of wedlock the mother has all rights to the child. Even if the male signed the birth certificate he still has to go through to courts to have it legitimized. If he doesn't do this then even if the mother doesn't have custody, custody could go to someone decided by family and children services, which could be one of her relatives. There is a possibility that once she is out she will get custody back if he is not fighting her for custody. So it would be a get idea to get a lawyer working before she gets out.

Your boyfriend should have full custody of the kids regarding to the story above and the mother is UNFIT and is in PRISON ...

A friend told me that another friend she knows had her daughter taken away when she went into prison and the father has full custody of her and the mom is out of prison now and has a very limit contact with her daughter and must have supervisor around the child.

You'd be amazed the rights incarcerated persons DO still have.

In your case, the ex girlfriend can apply for "power of attorney" rights and assign a person of her choice to become the child's "guardian" pending her release. It would take legal opposition, best voiced by direct relatives of the child, to attempt successful blockage of such motions.

You don't say why she is imprisoned or for how long. Without that info no one can give you a good answer Depending on those facts, the state may or may not seek to terminate her parental rights & p[lace the kids in foster care. If so the natural father may or may not be able to assert his rights. Tell him to see a lawyer top whom he can explain ALL the facts.

My son has 3 kids from his wife,but he got custody,cause his wife signed them away without reading the papers.She went to prison for child moslostion.she is now out and wants to be in the childrens lives.We were told that she no longer has any rights to her children.

I would bet it will be hard for her to have many rights. Child abuse,,pretty serious.
