I was driving home on a small one way street, just before pulling up to an all-way stop sign, I decided to dial my house. It was going to be a really fast call just to let my family know that I was close. I stopped at an all-way sign and saw an officer pull up simultaneously at a perpendicular street, at that point I took the phone away from my ear and put it on my lap with speaker mode. I signaled him to go first, he signaled me back to go first, as I drove by, he turned on his sirens and went after me and gave me a ticket, he said “it’s illegal to even hold a phone in your hand.” I think that’s a little absurd, I was on a tiny street with no cars and had the phone in my hand for only 10 seconds. I also own a headset and I would have used it for a longer call. I’d like to fight this ticket, does anybody have any advice ?

Take the ticket to court and tell the judge the exact situation. If the judge is reasonable he will probably throw it out. Just be honest about it.

Stop whinning and pay the fine. The city needs money and this is one of the easiest ways to get it. No judge will throw that ticket out and youll just waste you time and the courts, and they can fine you for wasting the court's time. Just let it go.
To all those who said that using your phone is such a bad thing your wrong, its been proven that talking on a cell phone is equivelant to listening to the radio while driving. The problem is dialing, since you are not paying attention to the road. But since he said he was at a all-way stop sign when he dialed there really was no great danger.

1. Your car is a lethal weapon. Your undivided attention is required at all times behind the wheel.
2. My mate was hit 3 times in her vehicle, sustaining injuries, because of drivers using cellphones while driving. They weren't paying attention. Unfortunately, the drivers were too self-involved to consider the safety of other drivers.
3. I am sorry, but you, and any adult using a cellphone while driving, need to think about the repercusions ahead of time. If that call is so important, pull over to the side of the road and turn your vehicle off.
4. That officer gave you a serious wake-up call. Learn from it. He's trying to make you think about safe driving practices, before you kill someone, or yourself. It's called 'learning the hard way'.

In Connecticut the law is very clear. Operation of a vehicle while holding or using a cellular phone is illegal unless using a speaker system or headset.
the fact remains you were using a phone while operating a vehicle. no defense. take it on the chin and next time use the speaker you have installed and should have been using. one way street...10 feet from your home or not.

yes, trust me on this, the same thing happened to my Dad
so I asked my friend who is a cop here in NJ what to do.
He said just pay the fine, don't take a day out to go to court because you will just loose anyway, so that's what
my Dad did. Best of Luck

Yeah, it's ridiculous & you weren't being reckless, but if that's that law - you broke it. Hopefully you'll get off if you tell the court your side of the story.
