My wife wants to travel out of state with our child. We were all supposed to travel together, but we have had a huge fight, and now she insists on going without me. I don't want her to take him out of state, fearing she might not return. What are my legal rights? I am in California.

Once she fails to return with the kid, you must file a report with the police within six months, or lose your parental rights.

It doesn't sound as if you are divorced so I don't think the custody issues will help here. If your marriage is in that much trouble, have you considered counseling? Was the huge fight worth your marriage? I'd be real careful before I got the police or CPS involved as that can be very bad. Once you are in the system, you can easily lose control of the whole situation.

Need a court order preventing out of state travel. Will need to show just cause!

Boy you don't really have much confidence in your wife, do you?

You can only "abduct" a child that you don't have any right of having (w/ a court order), so she wouldn't really be abducting him or her.

Apologize to your wife, and go with them. Grow up.

I don't really think there is anything you can do until she would actually take him and not return. Why do you think that she would not come back? Everyone has arguments, she may just need some time to cool off.

its just out of the state and she will be coming back wont she if not call the police but i dont think they will do anything because she is the mother

You can't really do anything. I have done this before with my kids. She is his legal guardian as are you. Just try to make up with her, that will be ur best bet! Good Luck...

call the local police station, they might give you some advice but as long as you two are still legally married, then not much you can do.
