I have a friend that entered into a one year lease contract in Florida to go to school and upon arriving in Florida she found out that she was unable to attend the college. She is a single young female living on her own her nearest friends or family being in Ohio, she wants to move back to Ohio. The apartments she lives in are unsafe the gate doesnt work and last night therere was shooting in her complex. When things need fixed they say that it will take awhile as the maintenance man is busy. Can she get out of her lease.

she has talked to her apartment and they say no sub leasing and in no way they will allow her to break lease for another 8 months.

Most leases have a clause that states the conditions that the lease contract can be canceled. She did get a copy of the lease agreement didn't she? Tell her to read it carefully, and look for that clause. She might be able to break the lease due to unsafe living conditions. Again read the lease, go to the housing authority and ask questions. She can not be forced to stay some place she doesn't want to be. She would probably forfeit her deposit and they may try to get the money owed for the remaining term of the lease,,,but they can not force her to stay. A little secret. Unless the apartment is managed by a large management company, lots of times they do not try to go after someone for the remainder of the lease. (former apartment manager knowledge) That is not to say that this place would not do that tho. Another thing. Has she put her maintenance request to the management in writing? This would prove that she had told them about it and that they have made no attempt to fix it. If they make no attempt to fix the problems they could possible be in violation of the lease.

She can try talking to the management office and let them know that the school she was to be attending didn't work out and that was the only reason she came there. I know in GA where we were living we had to give 60 days notice and pay for those 60 days. SOme places will refund you security depoist and some don't. It doesn't hurt to ask

the simplest way is to find someone to take over the tenancy, preferably by signing a new lease.
your friend could offer to pay one month of that new lease as an inducement. make sure it's signed first.

Yes I have a friend that said she felt unsafe at an apartment and they let her break it.
