she wants to go on a vacation before the trial. what are the chances of getting caught at the airport if she is back by the court date? no probation is involved yet

She can go to the court and get permission, then she'll be fine. Tell her to go in with an itinerary of her schedule, proof of reservations, etc. If it's not a serious charge, then they may give permission. Have her talk to her attorney. If it's a no go, then just forget about it.

The chances of getting caught at the airport seem slim, but the likelihood of some situation or circumstance occuring while on vacation that could interfere with her court appearance have too many variables that make it a good decision to do. Even under normal circumstances of staying clear of any trouble and making that court date is a risk for anyone. Is her vacation more important that her legal problem? If anything came up that caused her to miss or be late for that date, do you think the judge would even consider it valid? When it comes to the judicial system, your legal situation is the ONLY priority and they do not care about your job, your broken down car, your school, kids needing a sitter, or least of all a vacation OUT OF STATE. She already has a legal problem to take care of, why chance blowing it? She needs to take the law more seriously.

You want it as a percent? Not gonna get it.

The only answer is, there is a chance. Could she get caught? Yep. Could she be randomly screened? Yep.

Would she then be taken into custody? Yep.

Tell your friend not to be stupid. There's a lot more time later in life to take a vacation. These rules are set out as conditions of her release pending trial. Far more serious than probation. If she breaches these conditions, she is showing the courts that she can't be trusted to be out on bond or bail pending trial and they could very well hold her in custody all the way to trial.

Tell her to give her head a shake.

I'm reading all these responses, and I'd probably say "go for it!" But then again, I'm often stupid. Just be sure she's got time to get back by using a plan B in case she misses her return flight or something (Greyhound anyone? just tell her to hold her nose, and the air conditioning helps).
Of course with all this homeland security stuff happening, a random screening could be a bad thing nowadays. She doesn't mind a gamble does she? Just tell her to look as plain as can be for the flight.

You shouldn't take a chance because lets just say you get pulled over for a speeding violation and she is just passenger, she will have to spend time in jail and then get deported to her town for the trial where she will sit in jail again until her trail begins and her trial might be delayed so that they may process more paper work since he went out of her town or state. And if you or someone else is with her they may be (not quite sure) be able to be charged with aideing and abedding. It is just not worth it plus her bond to get her out if she even gets one will much higher.

just dont chance it
its not a matter of them throwing up a dragnet at the airport for your friend
its amatter of your friend being on vacation, getting a little shnockered, doing something lame, or worse, your frined not doing ANYTHING ataall, just some other wackadoodle doing something that drawsa ttention to your friend. the point is, your friend isnt supposed to leave the state. so just dont
it sucks

i was told the same thing not to leave but i had 2 months befor i had to go to court and didnt live in the state so i whent home and yes i flew but i came back befor my court date nothing was said about it but it was nothing big just a bar fight

She must be a high-stakes gambler. Is it really worth the risk to her? Personally, I think it would be a stupid mistake.
