This person has now a second offense with dwi and was on perscription drugs or something.Driving someones car without insurance.We have a high coverage and had to get a new car with payments that we didn't want.Injuries were sustained,but not yet serious.

You should have had your insurance take care of this. Yes, your premiums would go up but your company would sue the other driver to recoup their losses. Don't know about pain and suffering though.

You have no coverage for this. You could sue the driver but not even Perry Mason could get blood from a rock.
