I bought a brand new car on July 24, 2006, and 4 days later I got rear-ended. After so many phone calls, I finally got the other guys' insurance company to accept liability. The car was hit 45 mph, so the impact was pretty hard. Went to the chiropractor. Unfortunately the insurance company told me that they will repair the vehicle. So the question is besides, them repairing the vehicle, getting me a rental car, and pay me pain and suffering, which they only offer a little, what other compensation can I ask for? I really don't like to think that I will be making high payments for supposed to be brand new car, and it's not brand new anymore.

First: Redbugs doesn't have a clue. It doesn't matter how often you visit the 'witch doctor' chiropracter (that is exactly what they are) or if you have a lawyer, it does NOT make the claim worth one cent more than it is worth. You could very well be stuck with dozens of 'office visits' and lawyer fees to pay. The claims adjuster handles hundreds of these every year and they can determine extent of injury despite what those late-night TV lawyers and their bed buddy chiropractors tell you. If you are INJURED, then you need medical treatment.
Second: your vehicle was NOT struck at 45 mph by the other car (unless you are writing this question from beyond the grave) and your car certainly would not be repaired unless it is an armoured-up Humvee you brought back from Iraq.
Third: what other 'compensation' do you want? Hear's a news flash -- your car ceased to be 'new' the second you signed the dotted line. You ARE, however, entitled to diminished value since you will have to sell or trade the car someday along with a damage disclosure. The amount will not be what the repair costs are, they are calculated using a severity to cost formula, and should be paid direct to you and /or your leinholder.
I know all of this sucks the big one but you know what? Life just happens. I'm sure the other guy didn't do it on purpose as his life is going to be hell for a while also. Make the best deal you can, go to a REAL doctor if you NEED to and move on.

Get a lawyer and go to the doctor more. Pain and suffering is based on doctor visits. Keep complaining to the repair shop about any problems you have with the car now. It should be just as it was before. If you have missed work because of this then they will pay you for that too. A lawyer will get you more than you can on your own. They know how to work insurance companies.

I would certainly make that argument when they try to give you next to nothing for a settlement. Check around and find out what the depreciation factor is when a brand new car is in an accident after only a few days.

Also, don't be in a hurry to settle with the insurance company. They want to close their books as quickly as possible. Ignore their settlement offers and they will automatically bump them up.

I'm not for bilking the insurance industry, but it burns me up to think how I'd feel if that happened to me. Don't get greedy, but make sure you receive fair compensation. Nothing less, nothing more.

The most you can expect for repairs is to demand new parts. No repair of damaged parts.

Any injury must be determined by doctors. If any loss of wages/work, they have to reimburse that. Any more will become a civil suit against the other driver. Then his insurance co will be involved fight it.

It sucks, but that's just the way it is.

How about payment for future treatment you will need on your back because once you screw that up it's down hill from there. My DH and I were rearended by a drunk in feb of 03 and in April of 05 I was diagnoised with spodylosis. Deterorartion of the spinal cord, although it can be an inherited thing, normally 33 yr old son't haveit. It's one of those "old poeple" issues but having a back or spinal injury at a younger age can make it come out early. My Drunk filed for Bankrupcy and had his lawyer, who was also his brother, represent him so we will never get payment for what he did to me. GO AFTER THE SOB!!!
