I was pulled over for not have a seatbelt and given a ticket but i did have it on the whole time. I was reaching for my phone which was in my right pocket. It may have appeared that i was putting my seatbelt on while driving. Can i fight the ticket? if so how?

Your not going to like this but.... your screwed..... when you get in front of the judge it's your word against the cops. Unless you can convince the judge of this seat belt story, your gonna get fined. The best you can do is ask the judge to have the cop go outside and show him what you did, other than that pay the fine. The judge will have heard so many crying stories before yours.

yes, you tell the judge your side of the story,

first if you show up in court and the officer does not show up, the case should be dismissed anyway, if you plead not guilty.

But go to court and fight it.

( of course a seatbelt ticket is not a moving violation and in most areas don't count points on your licence, and normally you will lose more money taking off work to fight it, than you would pay for the ticket.

So I just pay mine ( of course I seldom wear seatbelts because I am alive today because I didn't, I was thrown clear and my car smashed and the driver compartment was gove completely) So I just pay the few I get from time to time.

I have wanted to appeal them up but can't afford to, I want to fight it on individual rights and the such.

T-on the back of the ticket,choose the option to have a trial,but most jurisdictions allow 14days.The cop usually has to go to court for all offences written and booked that are being contested,and he may not show,he may not have time to appear on a charge that he knows you may have adjourned.If,and if the officer shows,Dashboard camera may prove your innocence,or the judge may not believe the cop.I am in Toronto,but Ive been through the gears in both USA,and Canada.Fight IT!!!eddie/67

Most likely the judge will drop the charges if you pled non guilty to not having your seat belt on.. Explain to the judge in court what really happened. Tell him what you were doing. In a calm manor.
They'll have to believe your word. They will give you the chance to explain yourself. I know there is no proof. But sometimes if it sounds legit enough. They will either dismiss it or lower the cost.

Some officers make mistakes too...You have rights. If you know you didn't do anything wrong. You shouldn't have anything to worry about!!! Just try to fight it.

I hate to say this but cops do lie, sometimes they thought they saw something and insist you did it. If you have dark tinted windows or the seat was high where you can't see very well from behind the car, I would take a pictures to illustrate this to the judge chances are you might win. if the cop is'nt there at the court house the judge may dismiss it.

It should say in fine print on the ticket how to fight it. Or maybe there's a phone #. Odds are the cop won't show up in court so you'll win.

You can always fight it in court, but no doubt, it will be a hard one.
That happened to me once so i know your frustration.
My advice is that you just pay the ticket and go on with your life. Fighting it will just cause trouble and hassle and trust me, that's the last thing you want in this case.

Go to court and hope that the ticketing officer doesn't appear as a witness against you. You'll be able to present your case to the judge. Good luck!!!

You could go to court, but the court costs will be more then the ticket anyway... So just pay the ticket and be happy thats all he charged you with.

by writing a letter.... call the # on the back of the ticket, or go to the court house. explain the situation and u may be able to fight it
