If I eat at a restaurant and throw up from the food, can I sue?

Only if you can prove to a "jury of your peers" that you did nothing else that MIGHT have caused you to throw up, and you can show probablr cause that the restaurant did something (within their control) which DID.

The burden of proof is on you.

It's just food poisoning. You could report the restaurant, but sueing would take a lot of time and a lot of money. You can't really even prove it's food poisoning other than "you threw up." You could have had an allergic reaction or someone had the 24-hour flu.

Most restaurants carry insurance if a customer gets ill. Contact the restaurant. Their insurance company will probably settle the claim with you and avoid litigation.

That's what this country needs another frivolous law suit. Or a Business owner's Insurance premium's going up for no reason so they have to raise their price's to stay in business because another dead beat is looking for the easy buck because they are too lazy to go earn their money.

If the food made you sick because it was tainted or something was wrong with it (spoiled) or you got food poisoning, yes. If you just did not care for it and did it on purpose - well no.

I swear this is my mission to "spread the skit" from the Dave Chapelle show...

I went out again tonight, true story like usual, i drove my car into a wall, so then i decided it was bad so i built a new wall just for fun, then i sttod on the wall and ate rice crispies. Then i washed my car with canada dry and roof tiles
