"It should be a sin..."
It IS a sin. To sin means "to miss the mark" or to fall short. If we have to ask if something is right or wrong it shows that we are (morally) ignorant and lacking divine knowledge. Such a state of ignorance is a sin.
However, this world is in shades if gray, and so when someone asks, out of their sinfulness, a moral question for the sake of gaining knowledge, they have in fact lessened their sin (or advanced in virtue), and it should be considered a good thing.
Ultimately, if a person asks if something is a sin for the purpose of truly gaining moral knowledge, we could say that they are making virtue out of vice, and definitely moving in the right direction.
