I'm trying to negotiate getting a collection from a medical bill, that I thougth was paid by my insurance company, off my credit report. I'm more than willing to pay this if I owe it, but I have no idea how to go about having this entry removed from my credit.

If you thought that this was paid through insurance AND more importantly, if this WAS supposed to be paid by insurance, you need to contact your insurance company and find out what is going on. Find out if the debt was indeed paid. If it was not paid, find out why.

Make sure that you request the insurance company to send you everything in writing. Create a paper trail.

You should also request a FULL and complete accounting of your medical account with the medical provider. By law they are required to give it to you when you ask.

If you find out that the insurance company did not pay the medical bill due to the medical providers fault, you are not responsible in paying the bill as long as you had provided the insurance info to the medical provider. If that's the case, you would use the HIPAA letters to inform the original provider that the amount due is legally uncollectable.

If the medical provider had failed to file because they were not given the insurance info etc, you would use the HIPAA letter to pay the "orginal" provider. The original medical provider is then required (by law) to recall the account back from the collection agency and require the collection agency to delete anything about you in their own files and what they have placed on your reports.

I would suggest going to the site I've listed and do some reading in the medical forum about using HIPAA.

If your in negotiation and are talking to the collection agency. Tell them the amount you will pay for deletion. Most will probably tell you that they can't do that but if they can put it on your credit report they can take it off. You sound like you don't even know if it is correct, ask them to validate the credit entry. Simply ask them to show proof the debt and the amount is correct. If they don't do it, they are in violation of the law. On the letter you simply refer to the account number, the amount you agree to pay, and that they will delete the trade line. Make sure to say that you need them to send you a written agreement to the terms. Do not agree or accept an agreement over the phone. Make sure you get everything on paper.
