Hey guys... thought I'd ask this here, I got a credit card about two years ago and just about four months ago I hit a financial road block and have been unable to make much payments. They sent me to collections recently and they have (collection agency), understandably, been calling a lot, however I explained my situation many times but they do not stop calling.

Just recently they have been calling my girlfriend's house and I am not sure HOW they got her number. Her number is not listed which is even weirder. They call once every two weeks or so though. I did not put it on my card application because I was not with her at the time.

Do you know how this collection agency coulda got her number? And how I could get them to stop calling there?

She needs to submit in writing that they cease and desist; if they don't, report them.

Don't answer the phone if you recognize the number they are calling from.

According to the Fair Debt Collection Practices Act, no collection agency can contact you at a time/place that is known to be inconvenient to you. If you communicate this to them that they are to no longer contact your girlfriend at that number, then they must legally stop.

If you want to sue them for noncompliance, then you should send this as a written request (Certified US Mail preferably). Sometimes they will stop if you ask them verbally.

I do not know how they could have gotten her number, unless you have received mail at her address and it is listed on your credit report under another account. Hope this helps.

I'm willing to bet they probably pulled your LexisNexis report and got her number from that report.

With LN, there is no such thing as privacy. They may even list the name of the kid you shared a luch with in 2nd grade. (just joking there) But, many people do find that their LN report does contain info about other people in their lives, even neighbors who they have never met.

Your girlfriend should send them a full cease and desist.

You should not send one for yourself. If you do, soon after they receive it, you may find a process server at your door.

You need to find out the statute of limitations in your state.

You also should learn your rights and how to deal with a collection agency.

simply...
answer the call and tell them to put that number on the "do not call" list. Advise them that they are NOT to call this number.
Make a note of the time and date and the number they called from (if available) and the company.
If they call again... you can file charges.

Have you ever called from that number if so they can detect it they know who his calling even before you say your name because they are very sneaky I believe that your girlfriend can call her phone company and ask that all calls from those numbers be blocked

your girl can sue them for calling her ........she is not involve in your financial situation.........plus write to BBB
agency and let them know that this collection agency is using collection techniques that are not honorable you will how fast they will stop calling your girl...............
put some effor and they will stop arrassing everyone you know .....do it online so it goes faster

Write a letter to them and tell then don't call you, if they do, you can file a report on them.
