I'm just a little bit pissed,I'm an Australian,i tried doing it the legal way paid immigration lawyer ALOT of money and she ripped me off didnt file the forms quick enough before my 1-94 runs out but had my case for months, and now am being sent home,i am married to an American, what really gets me is my husband works for the police and he catches illegals immigrants all the time only to be told by ICE (homeland security) to let them go. He has served his country and is a retired vetran...Now we are making arrangments for him to come to Australia to live I just dont think its far.

I too would be ticked off! My husband is from Brazil and came on a Fiancee visa. Now he's a permanent resident. I guess the only thing I have to say is if possible file suit against your lawyer and for anyone else reading this do it yourself. It'll cost a lot less and you'll be in charge of when things get done and turned in. Just be sure to take the time to read EVERYTHING!!! It's worth a few hours of your time. Don't rely on someone else to do it for you, ignorance of the laws and procedures doesn't fly with immigration-DHS. Also be sure to ask lots of questions write down dates and know where all your documents are.
Just to answer AmyBaby: No you're not a citizen once you marry an American Citizen because there have been so many people that get married to Americans just to do that(Have you seen GreenCard). It's a lot more complicated than that. I believe you have to be married for at least 3 years (and prove a valid marriage relationship) before you can even apply for citizenship. I guess I better get back on the INS-DHS website and read up on it.

No its not fair, but nothing is. I find that very strange, everyone knows that once someone from a different country marries an American they're considered a citizen, or something like that. I live at the south border and have heard, seen it, even been offered money to marry some freeloader just so he can stay in our country. If your husband is a cop he should know the laws, if not he should have connections with people from court and at least find out.

Immigration is the one area of the US Government that is absolutely out of control. We simply do not have a Government that feels it is an important issue. The system is so broken, that it will take a huge amount of resources to fix. Instead we spend our money trying to set up a puppet state in the middle east. If you are married to an American Citizen, I don't see how you can be deported.
I have tried to get an immigration Visa to retire in Australia and it was turned down. I am self sufficient and would purchase real estate there, but I do not have the $100,000 in the bank they require. To me it seems unfair, but your situation is even more dreadful. Can you get the ear of an elected representative?

Sorry, my advise is never hire an immigration attorney, unless they are a trusted friend....I don't understand why you and your husband just didn't do it yourselves?
You have to be very diligent when it comes to these things. File everything, yourselves, I mean. You really can't rely on an attorney or ANYONE for that matter, they will only take your money....

I would call INS and report the immigration lawyer you had !
I'd be PO'd TOO !!!!!!
You did what you were suppose to do, the attorney didn't. How can that be your fault ???
How about asking another attorney ? It's not uncommon for attorneys to sue other attorneys, and I would think you have a case!!!

That does suck...it is totally unfair that your husband is ordered to just let some go, but then the establishment is making you leave the states for something like that. I wish I had some good advice for you, but I don't :(
