the child care worker grabbed him by this shirt a gragged him also and the put him towards the window and shouted at him to sit in the corner.The centre told me by phone 13 days after it had happend to my son.I requested a copy of the incident report because another staff member witnessed the incident and made a compaint to the director of this centre.The board as now told me in writing that this women will be getting her job back and she will be under supervision for 6 months then she will return to normal duties. i want to get advice of what civil action i can take against this women and this childcare because this physical abuse as happend to my baby and i need urgent advice from anyone whom may have law experience or my have happend to their child and what is the procedure pleade this is urgent!

As a paralegal, I can't give you advice on what to do but I can tell you that you should talk to an attorney who offers free consultation and explain your situation and they will tell you whether you have a case to sue or not. Secondly, make sure that the attorney you are going to talk to is a civil attorney not a criminal one unless you are planning to press charges against the woman who put her hands on your child. You could do both but a civil suit would better suit you since it has two advantages: 1 it would grant your child some sort of financial relief from the woman and the day care and 2 it would prompt the day care to release that woman should they lose their case so there isn't another recurrance of the magnitude. Once it is determined that you have a case, search for an attorney who takes cases on a contingency basis so it doesn't cost you anything if you lose or anything up front because they won't get paid unless they win.

First of all, you should have been informed that very day. In fact, you should have been given the incident report to add your signature to as well. Find another day care, obviously, then get a lawyer and start a lawsuit against the worker and the center itself for putting a known child abuser back into her job.

Regarding a civil lawsuit call an attorney, you may be able to file against the daycare center and the individual.
Criminally, contact your local law enforcement agency and file a formal report concerning this situation.

Additionally, report this incident to children's services. Here in my state, it would automatically launch an investigation into the daycare, and the worker. Their license may be pulled.

But I would agree, remove your child from this center because you don't know what else may happen.

Whats urgent is that you get your child OUT of there.To he*l with your job and any thing else that would cause you to put your child in an abusive place.
Then worry about pressing charges later.
My opinion,Fu*k the police,hang a foot in her @ss and tell the police why you did it.The police is going to have to arrest you,in this case, they wont want to.Make bail and go to court,tell the judge why you done it.Pay the fine and be done with it.
Lady: forget the above,I'm just pissed.But PLEASE,bring your presious child some were else.I recently got an answer to a question from a cop(37 years experence).He said "sometime we got to protect bad people from good people".

Take the child out of the daycare before the person returns. Do not subject your child to the fear that this worker may snap again. Beyond that, file a report with your local licensing center for child care workers. You can sue civily and, with as litigous a society as we are, probably will. Good luck.

File an incident report with the police. You have written evidence from the child-care facility. Perhaps also contact a lawyer to see if you can pursue civil action.

ll_Zodiaco.Piton_ll said it best. Kids today are out of control. My Father once told me that, when he was a child, if you got the strap at school, you didn't tell your parents when you got home 'cause they would take the strap to ya. He grew up to be a hard working individual, and didn't rob a liquor store or steal a car at age 13.

Well they need to keep a eye on those day cares. Try letting a family member Babysitt kids sometimes. Daycares aint always safe.

How about having discipline towards your rotten child. Im sure there was a reason why he/she was sat in the corner. Then people wonder why their teenage kids kill themselves, they have no mental toughness to deal with the real life things, why?? mommy and daddy were always there to take care of things for you and spoil you.

I gotta agree with pops on this one.The law has already let her go,they ain't gonna do nothing else.If it was my child I would find another daycare,bury my foot in the as$ of who ever grabbed my child,and worry about the consequences later.Your first priority is to protect your child ain't no law would tell me how to do it.
