I say it's a veggie!!!! The only reason people started calling it a fruit is ,way back when you didn't have to pay tax on fruit so they decided to call a Tomato a Fruit so they would not have to pay the tax. I still say it's a Veggie and that's that!!!!!

Tomato, common name for a vinelike herb of the nightshade family, native to the Andean regions of South America. The name also refers to the fruit of the herb. Once thought to be poisonous, tomatoes have become one of the most widely grown and commercially important vegetable crops. The numerous varieties differ greatly in plant form and fruit type, the latter ranging from a small currant size through cherry, plum, and pear forms to the large, nearly round fruits, 10 cm (4 in) or more in diameter, which are the most widely grown. All forms include red- and yellow-fruited varieties.

Although a tomato is referred to as a' vegetable'- it is a fruit because it has seeds. The same can be for quash and beans too but they all come under the vegetable section in the end.

In 1893 , the Supreme Court ruled that the tomato must be considered a vegetable, even though, botanically, it is a fruit.

In China, it is a fruit. However, in biology, it is a vegetable. If you look at the food triangle, it is listed in the vegetable column. But in China, it is and always will be a fruit. But it can be used either way, since it is a multi-use fruit/ vegetable.
