Yes he can. Please don't be brought down by people screaming at you on here for being with an illegal. No one can stop love, love knows no colors or status of citizenship. As long as the marriage is real then yes he can apply for citizenship after a couple years or so, at least in my area thats how it is. My friend is going through the process with her husband, he was even caught by immigration but because of his marriage was sent home to her again.

It depends upon the exact law at the time. Since the law is complicated, you need to find a competent and honest immigration attorney. I can tell you that marrying an illegal does not automatically get him his green card. If it is possible, there are papers which need to be filled out and fees, perhaps fines, to pay. All you are going to get here is hatred and racism, if you don't get a good answer from someone who has done it, in a day or two, delete your question and find an attorney.

To understand the hatred here, you need to think in terms of Nazi Germany, and the Russian Iron curtain.

There is a lottery he can enter in order to get a green card. And there is a better chance of getting one if the illegal is married.

Illegal is illegal, whether he fathers a child or not ... if you're not married now, and he's here illegally, he'll have to go back home and fill in the papers, or face deportation ... just marrying him here in the hope that he'll somehow become a citizen if you do won't wash ...

The first requirement to become a citizen is being a LEGAL resident for a certain number of years. Marrying you does NOT reduce that time. It MAY make it easier for him to attain legal status. I personally don't think it should, but I don't make the law.

If the child were born on US soil he's already a citizen. If you're a US citizen and the biological parent, then he's already a citizen.

Otherwise, no, he needs to be naturalized as does your spouse. A green card is not citizenship.
