legaly drunk is .10 i got a ticket for a .026 whats up with that isnt that like drink mouth wash or some thing

In TX the limit is .08. But there is not an absolute when it comes to intoxication. If a person does not have the ability to handle what is in their system, stumbling bumbling falling down...then they can be ruled intoxicated.
Yes .026 is under .1, but if you were proven to be intoxicated by the field sobriety tests or some other means then you may actually get slammed for that. On the other hand if all you blew was .026 the chances are the DA would not take the charges... so you could actually get off with that test result...maybe this lil incident will be like a wake up call...dont do that anymore.

No. You didn't. The State can only write a ticket below .08. State can write at .06. Most local police can't write a ticket below .08

There is no ticket at .026.

Unless they wrote you for DUI. which is not DWI.

Some states are .08. I blew a .34 the hospital the morning after I wrecked my car diving drunk. It's not worth it at all.

How old are you? If you're under the legal age to posses and consume, some states have a "not a drop" law. That allows the police to tag you for ANY positive alcohol test.
