My husbands ex-wife has just had a baby and was addicted to meth. Will she lose that baby, and my husband has 2 other children with her that he has custody of she gets them every other weekend will she lose them to.

If she gave birth to a meth addicted baby, I am sure that the doctors ordered a drug test. After that, social services will get involved and decide from there what is best for the child. If you know for a fact that this is true, and they do not pick up on it, then you need to call the number in your area for child abuse. The number should be in the government section of your phone book. Once they receive the report they will go to her house and check on her and her baby and they can have a drug test court ordered, and then decide what to do from there. If your husband wants her to not have custody, then he can go to the courts and plead his case and could possably win. In order for her to completely "lose" her kids I believe that she has to sign her rights over, unless the situation is bad enough, then I believe that they will give her a year in which to straighten up and get her child back, if she fails to do that then the courts can terminate her rights.

The laws covering child abuse, unfortunately, are still in development. They are wide open to interpretation. The unfortunate thing is, child abuse laws actually developed from animal abuse laws, which have evolved to be very clear cut. It's too bad child abuse laws haven't followed suit. I suppose they might in time.
It's less about the law and more about how the judge that she faces, rules. If Child Protective Services are notified, they should begin an investigation. If they find that the baby is indeed a drug-addicted infant, they would likely remove the child from the home. The other children will only be removed from the home if CPS feels there is an immediate danger. They would then face a judge who makes a ruling. Your husband should keep abreast of the situation and make himself known to CPS if he wishes to gain custody.
Unfortunately, these days, it's all about keeping the natural family together. They will likely look on the mother as the victim rather than the baby. If she is not abusing the child post-birth, they will consider her to be the one needing assistance (i.e. rehab). Sad but too true.

First you should develop a meth habit by using it several times a day. Then you need to find a man, preferably a fellow meth user. Then you get together and do the nasty and waala--you have a meth baby.......and a child with a world of hurt. As for you--prison, tubes tied, made to work in the hospital full of meth addicted babies.

Who came up with this law? ISIS? This is one of the worst lays passed lately. Living on the Tennessee Mississippi state line as I do,I see tons of stupid laws.
ABORTIONS ARE GOING THROUGH THE ROOF. The people who came up with this law are probably pro-life. I am sure that these women are too scared to even see a doctor go for prenatal checkups so infant mortality will also go up.
More and more women are faced with going to prison due to this. Women with no criminal record are losing their kids and their freedom. l know a girl who was taken from the hospital and straight to jail. Her bond is 150,000.00 dollars. They didn't let family members have the baby until the judge hears from family services.

That's a very touchy subject one never knows but your husband might end up with the new baby.A Meth Patient has rights so because she's in treatment the state might walk in & keep an eye on her or she could loose them that's a tough one to answer sorry.

We can only hope these innocent kids get a better home..and the mother can get help and be a REAL mother..not just a baby machine..
I feel if you give birth and the baby is addicted the state should make it mandatory for the druggie to get a tubal..

The correct answer is YES!!! If the baby tests positive for narcotics than the hospital has no other choice but to call child protection services. The only way the biological mother will ever get her child back will be through the courts.

Take that baby away from her ! I know she is not yours , but just think of how much better that little cutie would be with you. I would not even allow her to come around your step children ! Do whats best for the children. Do not worry about the moms feelings. If she is going to do crap like that , she doesn't deserve to be a part of her children's life.

Not sure about Tennessee's specific laws, but if she's taking methodone, it's probably prescription, right? It doesn't seem that anything could be done about it, assuming she has a valid prescription from a legally practicing doctor. If it were heroine or cocaine or anything else, they'd probably take the baby away.
