a terrible tradgedy happened in our home and now we cant live there! We were going to build a new house and remove the old but now the bank says no because we are a liability in case we are sued and then we would lose everything. I guess I should better explain.....my son tried to take a weapon from my nephew and the weapon....well i cant even type it but you get the picture. My nephew was only 9 yrs old and my son was afraid he would hurt himself. Ok so my question is what do we do and how do we go about getting help, we cant go on living with my sister(my nephew's mom) we love them and are trying to help them too, but we also need to have our own place. Any help or advice i should say, will be greatly appreciated. thanks.

First off let me tell you how very sorry I am that this has happened to you and your family. Bless your hearts. Maybe you could try to get a different house. Maybe a fresh start in a different location would help your family heal. They have different programs to help people after such things, unfortunately I can not think of the names of any off the top of my head, I wish I could. Tragic indeed. However, a liabilty as far as who filing suit? Your sister? I would suspect that there may be criminal repercussions regarding the failure of an adult to properly secure a firearm. Now this is only speculation on my part because I don't know all the details. sadly I suspect you're going to have to stay put and make the best (if that is at all possible) of your current situation. I would think that perhaps this may very well be your sister's hour of need as well. however her state of mind in this situation may not make being together terribly comfortable.
I guess you'll have to wait until everything settles down and take it from there. The best of luck to you and everyone else involved. I'd also remove every firearm from the residence and never have one back again.

you are in a tough situation, i have a lot of real estate experience but this is tough.If you want your own place consider just buying a n exisisting home, as i think a construction loan is not feasible unless you see a lawyer and get some type of signed,document from the other party indicating thet wont,and have no future rights to sue. you could then bring the document with you to provide it to the bankers. The best way to get your own place would to get a house by going rent to buy or contract for deed...cfd is the best bet.either way you will need a private deal between yourself and the seller,circumventing the need for a bank.

The only way you could go about it on the financial end is to have your sister sign a liability waiver. Check with an attorney and the bank to see if that would do it.

But I'd also suggest that you have your family priest/minister come over, and just consecrate the house. and have a memorial service for your lost nephew, though it sounds like the reconstruction is just as much for her as for you.

Well if you are worried about law suits do what all the corporations do and put the property in another name. You would think your insurance would pay for the home. Why did it not if it was damaged. If it is a spiritual thing and the house is sound and liveable sell it and move somewhere else. It is hard because everyone is going to know the story. Too much information is given out.

it seems to me that you have a sick nephew, and you want to move out because you don't want to be involved.... right? Just guessing from what i sense of your short story.
If you own that old house, you can sell it. If you can't afford to buy a new house, well, you can get a small apartment for you and your son and when the time comes that you can afford a new home, you can always get one. The most important thing right now is for you to have peace of mind. Good luck!

get a lawyer on your side it wasn't like your son ment to do it. I am very sorry to heard about your loss. I wont sell the house I would tear it down because with the house being gone the fear and nightmares will fade away also. I hope you find the peace and calm surrounding you are looking for. It isn't your sons falt he was protecting his cousion for danger It just happened. I was better to love than to have lossed doesn't make sense now but it will once you get your life back together. My deepest sympathy for you and yours at this time.

I would suggest contacting your homeowner's insurance agent and see what kind of coverage you have. Some policies may protect you in situations like this. IF your policy covers you, then I would contact the bank again and let them know that you have liability insurance, and the amount.

Many banks don't want to risk lending money if someone is already involved in a lawsuit. You could also consult an attorney for more options which may vary from state to state.

Oh my! Sorry to hear about your situation. Can you just sell the house and buy a new one? I am not sure if tearing the whole house down will bring closure if that is what you are looking for. The location would still be there. I would suggest moving to a different part of town and not travel to that street in order to not have to relive it.

My best answer to you is to get counseling on your loss. Next, if you can't live with your sister at this time, temporarily move into an apartment and rent out your house until everything clears. If not , you will have to bear the pain of living in the house with your sister.
