I was recently deployed to Iraq. Before that I was deployed to Cuba, both for a year plus. Because of the deployment, i was forced out of my gym contracts with Bally's Total Fitness. Both times Ballys first refused to stop my automated deductions but then, after threating lawsuits, they let up. Now because of this mess with Bally's, my credit score has dropped 130 points since my last credit check 2 years ago. Its the only negative score on the report. Now because of this, when i refinance in a month, I will be getting a horrible rate. Is there anything i could do about this?

Is Bally's the one listing on your reports or has it been sent to collections and they are listing, or both?

If it is only Bally's, send a dispute to the credit bureaus.

If it is with a collection agency, send them a debt validation letter. Send it certified mail return receipt. When you get the green card back, send a dispute to the credit bureaus.

You might to to the site I've listed and do some reading in the credit forum. Do a search on Bally's.

I just did a search and did a little bit of reading, it seems that many people have good luck in getting it deleted with their first dispute to the credit bureaus.

When doing your dispute - DO NOT use the free FACT-ACT reports, that will give the credit bureaus an extra 15 days to investigate. Use paid reports from each bureau and they will have 30 days to finish their disputes.

Hopefully you can get it off of your reports before you re-fi.

I've found that these fitness club contracts are drawn up with very few loopholes. They make it very difficult to break them.

You may find a way, by using the Soldiers and Sailors Relief Act. This law was changed in 2003 to help people in the National Guard or reserves, because they were being called into active duty. Because of the drastic change in income, many were finding their families evicted from their homes, or having default judgements placed on loans that they could pay.

Some of the provisions applied to leases and other forms of rental contracts. I'm not sure if fitness clubs are covered. But you could contact your company legal advisors for this advice.

By invoking the SSRA you will be voiding the contract, and that should get the negative credit history deleted.

If this doesn't work, your only other hope is by following Echo's advice and use the dispute procedures. But I don't think this is going to be successfull for you. Like I said, Bally's is on to this game, and they don't play nice with contract breakers.

I would dispute the debt. Your reasoning would be that you were supposed to be released from your contract but was instead wrongly billed. Most fitness contracts allow for very few out clauses, but a move or deployment would be the most likely scenario.
