First of all, if you have been charged with the crime, you should be aware that you could go to the law library in your state and find out what the statute of limitations are for that crime and then proceed from there but your lawyer should know what the statute of limitations are. Second, if you are charged with that crime, you should have your lawyer file a Motion for Discovery to find out what type of evidence they have against you and if the witness is the only evidence and they can't find this person, I would have my lawyer file for a speedy trial which will give the state 90-120 days to either try you or drop the charges.

You will have to wait until the military starts granting waivers for felony convictions again. As of right now, no branch is giving waivers for felonies. The Army was the last one to do it and we stopped over a year and a half ago. You're probably going to have to wait until the economy goes up and it's harder for the branches to recruit. Two years ago you were allowed to have one felony on your record as long as it wasn't domestic violence, a sex crime, murder, or drug trafficking.

If you have already been charged the statute of limitations is no longer in play
your attorney needs to make a motion for a speedy trial or summary dismissal
