My wife and I signed a contract to purchase a car in Arkansas. We where approved for financing on that Friday evening. By the time the following Monday rolled around we had second thoughts and wanted to return the car. My financing company had yet to sent the money for the car. The dealership asked to have a chance to find the car we really ended up wanting (which had a couple extra options) and was unable to find it. Upon asking to return the car they "hinted" that they "could legally take action". This situation has quickly turned from the the dealership willing to do anything to make us happy to "they may take legal action." I've been told by a few experienced dealership managers that since I have not given them any money, that only remote thing they could do is charge me for the 3 1/2 days I've had the car, but that they probably would not even do that. Can someone please advise.

Just a footnote: After sitting down with the General Manger of this dealership and discussing my situation, He was more than happy to allow me to return the car. He said He wanted me to be happy with my decision and consider them the next time I buy a car. Now I have to figure out if he was so gracious because I had not paid them yet or he was just being kind. It would not profit them to take me to court. I had not paid them for the car so in affect there was no deal. The only problem I had was at the end of the day when the salesman and the sales manager where unable to find the car I wanted, they then resorted to "I'm sorry, we can no longer discuss this issue with you." My advise would be to "NEVER" give a down payment or sign financing for a car unless you are 1000% sure you want it.

I can not say this enough!!!

The 72 hours rule that everyone keeps talking about applies to in home sales. It does not apply when you go to a "normal place of business". It was designed to prevent people from being pressured into signing contracts just to get the salesman to leave their home. When you go to a place of business, you always have the option of walking out. You can not walk out of a sales situation in your own home.

When you take delivery of a vehicle, and drive it off the dealers lot, you own it!! The dealer is not required to take it back, and most likely will not. If he does, you will have to buy another vehicle from him, because he is not going to refund your money.

Some Daimler Chrysler dealers are offering a 30 day return policy on their new cars, but there are many fees and conditions attached.

The dealer did not just let you take the car. You signed papers, one of which I am sure was either a finance contract or a promissory note that stated you would pay for the vehicle in a certain number of days. (This is standard procedure when the customer is getting their own financing)

You bought a car. You owe the money! If you took a delivery of a new car, and the dealer were to take it back, they must legally sell it as a used car, and there is quite a bit of difference in value. At the very least, you will be liable for the loss of value, and any and all legal fees.

Pay for the car! Live up to your word that you gave when you signed the papers!!!

You have to do two things: Read your contract to determine if and when you can back out of the sale. Check the laws of Ark. where the vehicle was purchased. Some states allow up to 72 hours to cancel a contract.
Since you signed and used the vehicle you may have a problem getting out of it. You are experiencing buyers' remorse. It is a condition that affects many people. Usually it goes away after a while.
If you cannot get out of the sale, consider buying the options you want and add them to the current vehicle, if possible.

You're at the dealer's mercy. Once you've signed to buy the car, it's your responsiblity to pay for it, financing or not. There's no "grace period" like there is for house purchases in some states. Check the contract. If it says you bought the car and agreed to pay in full, you don't have any recourse. The dealership might be willing to trade for the other car, if it saw some advanatge in doing so.

and yes they can charge you for the three days but that is all they can do
