Someone I know was deported. They were here legally. They were sponsored here back in 1983 by an American Citizen. He is from Portugal. He was deported because he was wrongly accused and convicted with a felony. He was here for 23 years before getting deported. He married an Amerian and raised four children with his wife who he is still marred too. He was deported because of the law that states that any alien convicted of a felony is automaically deported. I just want to know how to get him back here. He is a good person, not a criminal. The gov tore this family apart. I feel bad for the kids b/c their father was taken away from them.( I also want to add that the Immigration case was separate from the case where he got a felony) Meaning two trials.

His wife must petition for him using form I-130. When the petition is approved and sent to the Embassy in Lisbon for interview and adjudication, the consular officer will (rightly) refuse the visa. Then the wife must file for waivers of her husband's ineligibility and inadmissibility citing extreme hardship for her and their children, but waivers are very hard to get. In most cases, both the I-601 and the I-212 must be filed.

Hmmmmm, YOU say he was WRONGFULLY accused and convicted. I don't know if I believe that. Anyways, I feel the way 1hunglo does. Anyone who is here tenuously as an immigrant needs to take even more care than ever to not get into trouble.

so let me get this straight. he was convicted of a felony, but he's not a criminal. he should have thought about this before he committed the crime........................
