First question: Did your spouse enter the country legally or did he/she sneak through the border? If he/she snuck through the border, there's nothing that can be done.

If your spouse entered the US with a valid visa and ended up overstaying, then you need to begin the process for adjustment of status (I-485). The adjustment of status process is essentially the "green card" process through marriage. You should file an I-130, I-485, I-765, G-325, provide all supporting documents to USCIS.

Email me your address and I'll mail you a booklet I received from the Mexican government that will help a lot. There are a lot of addresses and phone numbers that can be called toll free in both Mexico and the U.S.

Marry him here in the US at the court house, then get an immigration lawyer. ( the court house will not ask for his visa, just a photo ID)

Call the board of immigration, I'm sure they would know........Just going to leave you and marry his mexican wife(that he already has probably) so that she and his 8 kids will then be legal residents as well huh

make him or her go back and get legal. I sure would not be proud of that, we have enough illegals here now. I hate to tell you, you are probably being used...why would someone do such a stupid thing? No offense but I just don't get it.
