My wifes, best friends fiance, yes this is real, is Filipano. He is not a US citizen. He has been here for 10 years. He started a job 2 weeks ago and they asked for his documentation for legal employment yesterday. Well his Visa has been expired for 5 years. He went down to the office his job sent him to. They told him to request a copy of the expired Visa and go to INS to apply for his Green Card.
Now understand he is a friend, however, the fact that he is an ILLEGAL immigrant by our governments standards should qualify him for immediate deportation hearings, especially since he has been illegal so long. In our current state of immigration debate and post 9/11 security concerns, though he is Filipino, do you think that anyone who has been illegal for 5 years should be allowed to remain in the US and pay only the $275.00 application fee to gain a new resident Visa?

There is NO PROVISION in the law that allows him to stay in the US by paying $ 275 for an application fee. Unless he is replacing his permanent resident card or obtaining a new naturalization certificate (US citizen), there really isn't anything he can do legalize his status in the US. I'm not sure if he's getting accurate information from that office, but I would urge him to seek LEGAL REPRESENTATION.

I think he should be deported. What's the Job pay he just denied a Legal citizen? You don't simply FORGET to renew a VISA he chose not to.

I can't get too excited about it. It isn't that one or this one it is 12 to 20 MILLION of them that gets me....
If he can get legal before he's deported, fine.
However, I think your wife's best friend is getting into a bad deal.

They just told hin that to get him to the office and when he gets there--SLAM. in the jail and back to where he came from.... at least thats what i hope.
